Military Attaché immediately visited General Staff and left aide-mémoire and summary of Foreign Office instructions and requested interview with D.I. personally after papers had been

studied.

General Higuchi received Military Attaché early this afternoon and made the following observations:

(1) He could not understand why recommendations of officials on the spot were not accepted.

(2) ne was surprised to hear that the fate of the four men was already assumed to be execution before they had been even

tried.

(3) Neither the Ministry of ar nor the General Staff could interfere with military dispositions made by local commander especially as it was considered that General Homma had already exceeded the limits of patience.

(4) Nevertheless as a gesture of appreciation for the

efforts made to achieve a settlement and in view also of the

friendship between General Homma and General Piggott, General Higuchi would send personal telegram to General Homma telling

him of the concern felt by myself and the Military Attaché at the way the situation was developing.

(5) At the same time he sincerely hoped that should
